Talent One Privacy Policy and SMS Terms & Conditions

Welcome to Talent One. This Privacy Policy describes how Talent One (“Talent One,” “we,” “us,” or “our”) collects, uses, shares, and protects your personal information, and explains your rights and choices. It also includes our SMS/Text Messaging Terms and Conditions, which outline how we manage text communications in compliance with applicable laws. By using our website and services (the “Services”), you agree to the practices described in this Policy.
Definitions
- Personal Information
- Any information that identifies, relates to, describes, or can reasonably be linked to an individual. This includes information like your name, contact details, account credentials, Social Security Number, etc.
- Services
- Talent One’s websites, mobile applications, and related services, including any platforms where Talent One offers employment or talent-matching services.
- Cookies
- Small text files stored on your device by websites to save preferences and track online activities. Related technologies include pixels, web beacons, and similar tracking tools.
- You/Your
- The individual who uses our Services or visits our website. This may be a job seeker, employee, independent contractor, or any other user of Talent One’s Services.
Data We Collect and How We Use It
We collect various types of Personal Information from and about you for business and operational purposes. We are committed to using this data in compliance with U.S. federal and state privacy laws. Below we explain what information we collect and the purposes for which we use it.
Types of Information Collected
- Information You Provide Directly: When you create an account, fill out forms, apply for opportunities, or communicate with us, you may provide personal identifiers such as your name, email address, mailing address, phone number, date of birth, and login credentials. If you are engaged as an employee or contractor through Talent One, we may also collect your Social Security Number or taxpayer identification and financial account information (e.g. bank account for direct deposit) for W-2 or 1099 tax reporting and payment purposes. We treat this sensitive information with high security and use it only for verification, payroll, and legal compliance.
- Professional and Employment Information: If our Services involve job matching or talent placement, you may provide a resume/CV, employment history, education, certifications, portfolio, references, or work eligibility documentation. We use this information to connect you with job opportunities or clients, and to facilitate hiring and talent management processes.
- Communications: Any communications you send to us (emails, customer support inquiries, feedback) or communications within the platform (messages with prospective employers or talent) may be collected. This information is used to respond to you, provide support, and improve our Services. We may also retain records of your opt-in consents for communications (email or SMS) to demonstrate compliance with laws.
- Automatically Collected Data: When you use our website or app, we automatically collect certain information about your device and usage through cookies and similar technologies (see Cookies and Tracking Technologies). This may include your IP address, device identifiers, browser type, operating system, pages viewed, links clicked, and dates/times of access. We use this data to secure the Services, prevent fraud, debug errors, and understand how users navigate our site.
- Geolocation Data: We may infer your general location (e.g. city or state) from your IP address or mailing address. We do not collect precise GPS location unless you expressly allow it via your device settings. Location info helps us show relevant job postings in your area and comply with any time zone requirements (like “quiet hours” for texts).
- Information from Third Parties: We may receive information about you from other sources. For example, if a prospective employer or client uses Talent One to find candidates, they might provide us with information about you (like a referral or interview details). If you integrate your profile with a third-party platform (e.g., LinkedIn), we receive the information you authorize from that platform. We treat third-party provided data in accordance with this Policy.
How We Use Personal Information
- Providing and Improving Services: We use your info to create and manage your account, enable job search or talent matching, and facilitate communications between you, Talent One, and prospective employers or clients. For instance, we use your profile/resume to match you with suitable opportunities or clients with qualified talent.
- Communications: We use your contact info (email, phone) to send Service-related communications (account confirmations, feature or policy updates, support responses). If you opt in, we may also send marketing or promotional messages like newsletters or job alerts, in accordance with relevant consent requirements (TCPA, CAN-SPAM). You can opt out at any time.
- SMS Text Messages: With your express consent, we use your mobile number to send automated text messages (job alerts, status updates, promotional offers). See the SMS Terms & Conditions section for details. We only send marketing texts if you’ve given prior express written consent, and we abide by time/frequency limits.
- Hiring & Payment Processing: If you become employed or contracted through Talent One, we use your Personal Information (including SSN or bank account) for payroll, direct deposit, W-2/1099 issuance, verifying identity/work eligibility, and administering benefits. We share it only with service providers (like payroll processors) or authorities as needed, securing it at all stages.
- Analytics & Product Development: We analyze usage data and feedback to improve the user experience, develop new features, and refine job matching or talent matching. We often use third-party analytics tools (like Google Analytics) for these purposes, as described in Cookies.
- Advertising & Marketing: We may show you relevant content/ads on our site, partner sites, or social media. For example, using cookies/pixels to retarget ads on Facebook or Google. We do not share your contact details with external advertisers for their own use without your consent. Any limited “sharing” for cross-context behavioral ads is done lawfully and with opt-out mechanisms provided.
- Security & Fraud Prevention: We use your data (account info, usage logs) to protect the Services, detect/prevent fraudulent activity or unauthorized access, and ensure compliance with our Terms or laws. For instance, we may lock suspicious accounts or verify identities if there’s a suspicion of misuse.
- Legal Compliance & Protection: We may keep or disclose info to comply with legal requirements (regulations, subpoenas, or enforcement requests) or to protect Talent One’s rights/users’ safety. This might mean retaining certain records, verifying compliance with mandated processes, or cooperating with law enforcement for wrongdoing investigations.
Sharing of Information with Third Parties
Talent One does not sell your Personal Information for monetary consideration to third parties. However, we do share certain categories of data with trusted partners for business or operational purposes, always under obligations to protect your information. Below are typical scenarios of data sharing:
- Service Providers: We share data with third-party vendors who help run our Services (e.g., Mailchimp for emails, SMS gateways, cloud hosting, payroll processors, analytics like Google Analytics, etc.). These vendors only access your info as needed to do their jobs and must protect it under contract. Phone numbers collected and consent received will not be shared with any third-party providers for marketing purposes. This includes SMS opt-in consent data, which will not be shared under any circumstances with external parties outside the scope of providing or maintaining our SMS service.
- Analytics & Advertising Partners: We may use cookies or pixels from Google Analytics, Meta (Facebook/Instagram), etc., to understand site traffic and show relevant ads. These partners may receive certain device or browser info, but no mobile information is shared for marketing/promotional purposes. You can opt out of tracking or targeted ads using the tools in our Cookies section.
- Business Partners & Clients: If you apply for a job or undertake a contract via Talent One, we share necessary info (like resume, contact details) with the relevant third party at your direction. We only share what’s required and with your knowledge or consent.
- Third-Party Plugins or Integrations: Our site may have plugins or logins (e.g., Google/LinkedIn). These services might collect data under their own privacy policies, though we strive to ensure they only use your data as needed for the integrated functionality.
- Legal & Compliance Disclosures: We may disclose info if required by law or when necessary to protect our rights or investigate wrongdoing (e.g., responding to subpoenas, defending legal claims).
- Business Transfers: If we’re acquired, undergo a merger, or transfer assets, your data may be included in that transaction under continued protections.
- With Your Consent: If we propose to share info beyond these uses, we’ll ask you. You can choose to allow or deny that sharing.
Note for California Residents: We do not “sell” personal information for money, nor share minors’ info for cross-context ads. However, some ad/analytics activities might be “sharing” under the CPRA. You can opt out by contacting us or using our cookie controls.
Cookies and Tracking Technologies
We use cookies and similar tools to run and improve our Services, personalize your experience, and show relevant ads. These might include session cookies (for essential site functions), analytics cookies (to measure usage), and advertising pixels (e.g. Facebook Pixel). Your Rights and Choices

California Privacy Rights
California residents can request: (1) to know what personal info we collect and share, (2) to delete or correct it, and (3) to opt out of “sales/sharing.” We do not sell minors’ info or share any phone number with third parties for marketing. You can exercise these rights by contacting us. We’ll verify your identity before fulfilling certain requests and respond within the legal timeframe.
Children’s Privacy
Our Services aren’t directed at children under 13, and we don’t knowingly collect their data. If you believe we have a child’s info, contact us to remove it. Teens 13–17 may use our Services with parental permission.
Data Retention and Security
We keep personal info as long as needed to fulfill the purposes in this Policy or to comply with legal obligations. We have security measures (encryption, restricted access, etc.) to protect against unauthorized access. However, no system can be 100% secure. If a data breach occurs, we’ll follow applicable notification laws.
International Data Transfers
We are U.S.-based. If you’re outside the U.S., your data may be transferred to our servers here or in other jurisdictions. We’ll handle these transfers lawfully and protect your data in line with this Policy and any relevant laws.
Updates to This Policy
We may update this Policy periodically. If changes are significant, we’ll notify you (e.g. via email or prominent notice). Continued use after the effective date means you accept the revised Policy. Check back occasionally for updates.

SMS/Text Messaging Terms & Conditions
The following terms govern any Talent One SMS/text message communications. By opting in, you agree to these SMS Terms & Conditions and our Privacy Policy. We comply with TCPA, CTIA, and other relevant regulations to protect your rights.
1. Opt-In Consent & Enrollment:
We only send SMS if you explicitly agree (e.g., checking a box or replying
“YES”). By consenting, you allow us to send recurring automated texts (updates,
alerts, promotions) to your mobile number. Your consent is not a
condition of purchase or use. If you do not wish to receive texts, do not opt
in, or follow the opt-out steps below.
2. No Third-Party Sharing of Phone Numbers:
No mobile information will be shared with third parties/affiliates for
marketing/promotional purposes. All other categories exclude text messaging
originator opt-in data and consent; this information will not be shared
with any third parties. We explicitly state that phone numbers
collected and consent received will not be shared with any third-party
providers for promotional use. This excludes SMS opt-in consent data,
which will not be shared under any circumstances with external parties.
3. Message Frequency:
Our SMS frequency varies depending on your actions and opt-ins (e.g., job
alerts may be sent whenever a new match appears). Typically, we limit
marketing messages to only a few per month. You can reply “STOP” any time
to halt these messages.
4. Message & Data Rates:
Standard carrier message/data rates may apply. Check your plan for details.
Talent One is not responsible for carrier fees, and not all carriers may
support our SMS service.
5. Opt-Out:
Reply STOP to any message to unsubscribe. We’ll send a
confirmation text and then no more marketing/promotional texts will be sent
unless you rejoin. For help, reply HELP or contact us at privacy@thetalentone.com.
6. Quiet Hours:
We do not send marketing or promotional texts before 8:00 AM or after 9:00 PM
local time to respect your time zone. Transactional or urgent service
messages (e.g., password resets) may be sent if necessary, but marketing
is restricted to allowed hours.
7. Identification of Sender:
You’ll see “Talent One” as the sender or within the SMS content so you know
it’s from us. We never request sensitive personal or financial data via SMS.
If you get a suspicious text, let us know immediately.
8. Your Mobile Number & Responsibilities:
You represent you own or control the mobile number used for texting. If you
change or deactivate it, inform us so we can remove it. We’re not liable if
a reassigned number receives texts without our knowledge.
9. Supported Carriers & Availability:
Most major U.S. carriers support our texts. Delivery depends on your carrier
and coverage. Carriers are not liable for delayed or undelivered messages.
10. Changes to SMS Terms:
We may update these terms to meet changing laws or service features. If we
do, we’ll notify you (e.g., via text or website). Continued enrollment
means you accept the new terms. If you disagree, reply STOP or contact us
before changes take effect.
